A<\/span> group of <\/span>young women<\/span> stood outside the Supreme Court on Tuesday to urge the court to protect women\u2019s sports and affirm biology and common sense. The Supreme Court may rule on <\/span>West Virginia v. B.P.J<\/span><\/em> in the <\/span>coming days,<\/span> which turns on whether biological sex or gender identity can decide who qualifies to compete in women\u2019s sports.\u00a0<\/span><\/p>

The reality is that a ruling for BPJ wouldn\u2019t just allow her to compete in women\u2019s sports \u2014 it would upend the integrity of women\u2019s sports as a whole.<\/p><\/blockquote><\/div>

Faith Ozenbaugh, the National Director of Young Women for America, said, \u201cWe hope this case protects biological women. We\u2019ve advocated for separation of men and women in sports. We desire that all women be protected in locker rooms, bathrooms, etc.\u201d<\/span><\/p>

YWA Intern Ruth Kiija agreed, \u201cWe\u2019ve seen instances where someone\u2019s identity was protected over women as a whole. You can\u2019t argue with biology. A man is still a man. A woman is still a woman.\u201d<\/span><\/p>

West Virginia vs. BPJ<\/em> has become a case of immense national significance. Becky Pepper-Jackson of West Virginia was born a male but now identifies as a girl, and received puberty blockers as a child. Pepper- Jackson was not able to join the girls\u2019 sports team as West Virginia <\/span>mandates sex-separated sports<\/span>.\u00a0<\/span><\/p>

West Virginia passed the \u201cSave Women\u2019s Sports Act\u201d in 2021, which ensured only biological women could compete in women\u2019s sports. Pepper-Jackson argues that it violates <\/span>Title IX<\/span> of the Education Amendments of 1972 and the <\/span>Equal Protection Clause<\/span> under the 14th Amendment. Her <\/span>lead counsel,<\/span> Sruti Swaminathan, <\/span>argued<\/span> that to deny her a place on the women\u2019s team would be to discriminate against her as a transgender girl.\u00a0<\/span><\/p>

Although the law went into effect, the Fourth Circuit Court of Appeals later <\/span>ruled in her favor<\/span>, agreeing that it violated Title IX. Because of this, she was permitted to compete as the litigation continued.<\/span><\/p>

West Virginia appealed to the Supreme Court. The court <\/span>heard arguments<\/span> in January of 2026, and it is believed that the judges will vote <\/span>in favor of West Virginia<\/span> as evidenced by sentiments of conservative judges.\u00a0<\/span><\/p>

Judges have voiced disagreement with the way Perry-Jackson is using Title IX and the Equal Protection Clause to argue her case. <\/span>Chief Justice John Roberts asked<\/span> Kathleen Hartnett<\/span> to elaborate on \u201cwhether or not we should view your position as a challenge to the distinction between boys and girls on the basis of sex or whether or not you are perfectly comfortable with the distinction between boys and girls, [and] you just want an exception to the biological definition of girls.\u201d said Roberts. He stated that an exception like this \u201cwould have to apply across the board and not simply to the area of athletics.\u201d<\/span><\/p>

Justice Amy Coney Barrett pointed out<\/span> the way a BPJ ruling would particularly hurt women\u2019s sports when she asked Hartnett, \u201cHow would we say this discriminates on the basis of transgender status when\u201d \u201ctrans boys can play on boys\u2019 teams,\u201d so that the effect of the law \u201creally only runs towards trans girls?\u201d<\/span><\/p>

The reality is that a ruling for BPJ wouldn\u2019t just allow her to compete in women\u2019s sports \u2014 it would upend the integrity of women\u2019s sports as a whole. If gender identity rather than biological sex is the criterion for making the cut for the women\u2019s team, the future of women\u2019s sports is not secure.<\/span><\/p>
