I<\/span>n a move to protect the integrity of U.S. citizenship, President Trump signed <\/span>two new executive orders<\/span> on Thursday, Aug. 6, in an effort to permanently end \u201cbirth tourism\u201d and limit birthright citizenship in the United States. Coming on the heels of the Supreme Court\u2019s ruling in <\/span>, the new measures seek \u201cto continue to protect the meaning and value of American citizenship,\u201d according to a <\/span>White House fact sheet<\/span>.<\/span><\/p>\n

The number of people exploiting the practice of \u201cbirth tourism\u201d in the U.S. is growing, with a recent estimate of 26,000 babies obtaining citizenship in this manner every year.<\/p>\n<\/blockquote>\n<\/div>\n

The first order Trump signed nonexhaustively listed different people who are not allowed to obtain automatic citizenship even if born on U.S. soil, such as the children of foreign emissaries and terrorists. These rules were also upheld in a recent Supreme Court ruling.\u00a0<\/span><\/p>\n

The second executive order specifically directed the banning of \u201cbirth tourism,\u201d the practice of foreign nationals traveling to the U.S. on visitor visas solely to give birth and secure automatic U.S. citizenship for their newborns. Essentially, this order called upon the secretary of state, the secretary of homeland security, and the commissioner of Social Security to restrict such visas and enforce the order among all government departments so that \u201cno one in the world is anymore allowed to obtain a visa for \u2026 fraudulent purposes,\u201d <\/span>according to senior advisor Stephen Miller<\/span>.\u00a0<\/span><\/p>\n

The new executive orders are not the Trump administration\u2019s first attempt to restrict this type of loophole citizenship. Back in 2020, Trump first launched the initiative by publishing a fact sheet stating that by eliminating birthright citizenship, \u201ctogether, we will create an immigration system to make America safer, and stronger, and greater than ever before.\u201d<\/span><\/p>\n

Additionally, in the summer of 2025, the Trump administration signed an executive order that similarly sought to deny birthright citizenship to U.S.-born children whose parents lacked U.S. citizenship or lawful permanent residency. <\/span><\/p>\n

However, the 2025 executive order was ruled unconstitutional in <\/span>Trump v. Barbara<\/span><\/i> in June 2026. The court ruled, in a 6-3 decision, that the order violated people\u2019s 14th Amendment right, which states, \u201cAll persons born or naturalized in the United States \u2026 are citizens of the United States and of the State wherein they reside.\u201d In the briefing on Thursday, <\/span>Miller responded<\/span> to that argument, claiming, \u201cThe Fourteenth Amendment was passed exclusively in the aftermath of the Civil War to ensure the children of slaves would be citizens. It had no other meaning or purpose outside of that.\u201d<\/span><\/p>\n

Many political analysts say Trump\u2019s actions Thursday will likely face legal challenges. According to the <\/span>American Civil Liberties Union<\/span>, \u201cThe Supreme Court has already decided the issue,\u201d and that this new executive order will likely \u201cmeet the same fate as the last one.\u201d Still others support Trump\u2019s efforts and maintain that \u201cbirth tourism\u201d is a major issue of fraud in the U.S., and enforcing strict visa rules falls squarely within the executive branch\u2019s constitutional authority to protect national sovereignty.\u00a0<\/span><\/p>\n
